GOVERNOR SIGNS BILLS

COLUMBUS (November 21, 2001) — Governor Bob Taft has signed the following bills, which will be filed with the Secretary of State’s office: Substitute House Bill 126, sponsored by Representative William Seitz (R-Cincinnati), provides a four-year statute of limitation on any civil or criminal action or proceeding under the Antitrust Law. The bill goes into effect 90 days upon the Governor’s signature and filing with the Secretary of State.

Amended House Bill 362, sponsored by Representative James Trakas (R-Independence), eliminates electrocution as an option for the execution of a death sentence and requires the use of lethal injection as the means of executing all death sentences; provides a mechanism for determining the manner of execution of a death sentence if lethal injection is determined to be unconstitutional; declares an emergency. The bill contains an emergency clause and goes into effect immediately upon the Governor’s signature.

Substitute Senate Bill 110, sponsored by Senator Bruce Johnson (R-Columbus), is relative to the authority of a corporation to issue option rights or securities having conversion or option rights with respect to shares, the acts of a director of a corporation relating to an acquisition or potential or proposed acquisition of control of the corporation, and the general duties of a director of a corporation. The bill goes into effect 90 days upon the Governor’s signature and filing with the Secretary of State.

Substitute Senate Bill 116, sponsored by Senator Robert Gardner (R-Madison), permits institutions that grant baccalaureate degrees approved by the Board of Regents under Sec. 3332.05 of the Revised Code on the effective date of this act, are operated by a for-profit corporation, and are not state-assisted to be regulated exclusively by the Board of Regents. The bill goes into effect 90 days upon the Governor’s signature and filing with the Secretary of State.

Substitute Senate Bill 119, sponsored by Senator Steve Austria (R-Beavercreek), permits multiple transfers of service credit and contributions between Ohio's state retirement systems and requires employers to file reports regarding the employment of peace officers to the Ohio Peace Officers Training Commission. The bill goes into effect 90 days upon the Governor’s signature and filing with the Secretary of State.

Amended Substitute Senate Bill 122, sponsored by Senator Scott Oelslager (R-Plain Township), is relative to the determination of a defendant's competency to stand trial and whether or not there is a substantial probability that the defendant will become competent to stand trial if provided with a course of treatment. The bill goes into effect 90 days upon the Governor’s signature and filing with the Secretary of State.

Amended Substitute Senate Bill 136, sponsored by Senator Lynn Wachtmann (R-Napoleon), exempts certain retail food establishments from the licensing requirement of the Retail Food Establishment Law, modifies requirements relative to wholesale food establishments, establishes new requirements for cottage food production operations and specified other food producers, and declares an emergency. The bill contains an emergency clause and goes into effect immediately upon the Governor’s signature.

Substitute Senate Bill 158 , sponsored by Senator Lynn Wachtmann (R-Napoleon), regarding organ donor designations made by persons over age 18 and use of funds for organ donor awareness programs in schools; declares an emergency. The bill contains an emergency clause and goes into effect immediately upon the Governor’s signature.
