GOVERNOR SIGNS BILLS

COLUMBUS (December 30, 2002) - Governor Bob Taft today signed the following bills, which will be filed with the Secretary of State's office.

Substitute House Bill 198, sponsored by state Representative Jon Peterson (R-Delaware), requires delinquent property tax collections to be distributed among taxing districts in proportion to current tax rates, rather than the rates in effect while the taxes were outstanding; and requires that a county auditor's tax valuation certification be issued ten days after requested and filed with any resolution or ordinance certified to a county board of elections by a taxing authority. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Amended Substitute House Bill 510, sponsored by Representative Ann Womer Benjamin (R-Aurora), is relative to the Department of Rehabilitation and Correction. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Amended Substitute House Bill 513, sponsored by state Representative Bill Seitz (R-Cincinnati), authorizes taxing authorities to create multiple reserve balance accounts for rainy day funds; expands the authority of townships pertaining to the permanent endowment fund for their cemeteries; authorizes townships to sell real property under certain circumstances without a public auction or competitive bidding; authorizes townships to declare a road obstruction to be a nuisance and to order its removal; and permits authorized township officers and employees to incur obligations of up to $2500 without prior approval. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Amended House Bill 515, sponsored by state Representative Jean Schmidt (R- Loveland), makes changes relating to the keeping of the board of township trustees' journal, the taking of minutes of board meetings, and the public of board resolutions in a home rule township; allows civil service townships that are urban townships to appoint any one of the three highest scorers on a police or fire department promotional exam; and places urban township employees in the same occupational classifications as municipal employees for workers' compensation purposes. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Amended House Bill 533, sponsored by state Representative Stephen Buehrer (R-Delta), permits the testimonial privilege between a physician and a deceased patient to be waived by any party to a will contest action. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Substitute House Bill 548, sponsored by state Representative Jeffrey Manning (R-North Ridgeville), clarifies that no fees related to certain protection orders and consent agreements may be charged. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Senate Bill 191, sponsored by state Senator Bob Spada (R-Parma), strengthens and revises the licensure process for MR/DD residential facilities. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Amended Substitute Senate Bill 217, sponsored by state Senator Larry Mumper (R-Marion), revises the Pesticides Law. The bill goes into effect on July 1, 2004; one section goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.

Substitute Senate Bill 245, sponsored by state Senator Lynn Wachtmann (R-Napoleon), provides that certain medical physical examinations required by statute may be performed by clinical nurse specialists, certified nurse practitioners, and certified nurse-midwives. The bill goes into effect 90 days upon the Governor's signature and filing with the Secretary of State.
