ODJFS delays proposed rules that would limit Medicaid covered services

The Ohio Department of Job and Family Services (ODJFS) has announced that it is delaying proposed rules that would limit the scope of services available to many adults and children under Ohio Medicaid. The proposed rules were scheduled to be reviewed by the Joint Committee on Agency Rule Review (JCARR) on Monday, December 3.

The rules had drawn universal opposition by people with disabilities, their families, and advocacy groups. In support of those opposing the rules, OLRS provided comments to ODJFS suggesting that the limitations in the rules violated several aspects of federal law, including Medicaid and the community integration mandate of Title II of the ADA and Section 504 of the Rehabilitation Act (see Letter from OLRS commenting on proposed changes and limitations to Medicaid covered services - PDF file). OLRS will continue to monitor the rulemaking process for further developments.
